Terms & Conditions — Present City

Welcome to Present City, an online store offering souvenirs, gifts, handcrafted items, and travel-inspired products. These Terms & Conditions (“Terms”) explain the rules that apply when you use the Present City website or place orders through it. By accessing or using our site, you agree to these Terms.

If you do not agree with any part of these Terms, please do not use the site.

2. Definitions

  • Platform / Site — the Present City online store and associated services.

  • You / Customer / Buyer — anyone visiting the Site or purchasing goods.

  • Seller — Present City (we are the seller of the goods listed on the Site, unless otherwise stated).

  • Products — souvenirs, gifts, handcrafted items, personalized goods, and related items sold on the Site.

3. Applicability

These Terms apply to all purchases of Products through the Present City website. Additional terms may apply to specific promotions, personalized items, or third-party goods; where there is a conflict, the product-specific terms will take precedence.

4. Age and eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account and place orders. If you are under 18, you may use the Site only with involvement of a parent or guardian.

5. Product information & availability

  • We make reasonable efforts to display accurate product information, including descriptions, dimensions, materials, and images. However, colours and textures may vary slightly from photos.

  • Many souvenirs are handcrafted or limited edition; slight variations are normal and are not defects.

  • Availability is subject to change. If an ordered Product is out of stock after you place an order, we will notify you and offer a refund or alternative.

6. Orders and acceptance

  • Placing an order constitutes an offer to buy the Products selected. We reserve the right to accept or decline orders for any reason (e.g., stock, pricing error, or suspected fraud).

  • Order confirmation e-mails acknowledge receipt of your order but do not constitute acceptance. Acceptance occurs when we dispatch the Product or notify you that the Product is ready for collection.

7. Pricing and payment

  • All prices shown on the Site are in the currency indicated and include applicable taxes where specified. Shipping and handling fees are added at checkout.

  • We reserve the right to correct pricing errors. If a Product was listed at an incorrect price and we cannot supply it at that price, we will contact you to cancel or re-price the order.

  • Payments are processed by third-party payment providers. By paying you agree to their terms in addition to ours.

8. Personalised and made-to-order items

  • Personalised, engraved, printed, or otherwise customised Products are made to your specifications and are therefore generally non-returnable unless faulty.

  • Check spelling and personalization details carefully — we are not liable for mistakes you submit.

9. Shipping & delivery

  • Delivery times vary by destination, Product, and production time for personalised items. Estimated delivery times are provided at checkout.

  • You are responsible for providing an accurate shipping address. We are not responsible for delays caused by customs, carrier issues, or incorrect address information.

  • International orders: customs duties, taxes, and import fees may apply and are the responsibility of the recipient unless stated otherwise.

10. Returns, cancellations & refunds

10.1 Consumer rights

  • Consumers have a statutory 14-day right of withdrawal (cooling-off period) starting from the day you receive the Product, unless an exception applies (see 10.3). During this time you may inspect the Product but must not use it. Returned Products must be unused, undamaged, and in their original packaging.

10.2 How to return

  • To return an item, contact our customer support at [Insert support email] or follow return instructions in your order history. Returns made without following our instructions may be refused.

  • You are responsible for return shipping costs unless the Product is faulty or incorrectly described.

10.3 Exceptions and special cases

  • Personalised/custom items, perishable goods, and items sealed for hygiene reasons once unsealed are generally excluded from the 14-day right of withdrawal. This also applies to items clearly personalised to the buyer’s specifications.

  • If a Product is faulty or materially not as described, notify us immediately and we will provide instructions for a replacement, repair, or refund.

10.4 Refunds

  • Refunds for accepted returns are issued within 14 days of our receipt of the returned Product and will be credited using the original payment method, subject to any applicable deductions for loss of value due to use or damage. Original shipping costs are non-refundable except where the Product was faulty or wrongly described.

11. Damaged or faulty items

  • If your Product arrives damaged, please keep the packaging and take photos of the damage. Contact us and include photos and your order number. We will advise whether to return the item and will handle replacements or refunds in accordance with applicable consumer law.

12. Gift cards & promotional codes

  • Gift cards and promotional codes are subject to their own terms (expiry dates, eligible products, one-time use limitations). Lost or stolen gift cards may not be replaced.

13. Intellectual property

All content on the Site — including text, logos, images, and design — is owned or licensed by Present City. You may not copy, reproduce, or use any Site content for commercial purposes without prior written consent.

14. User accounts & security

  • You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of any unauthorized use.

  • We may suspend or terminate accounts that breach these Terms.

15. Communications & marketing

By creating an account or purchasing, you may be signed up to receive order updates and promotional communications. You can opt out of marketing messages at any time, but transactional messages (order confirmations, shipping notices) are mandatory.

16. Limitation of liability

To the maximum extent permitted by law, Present City’s liability for any direct loss arising from purchase of Products is limited to the purchase price paid for the relevant Product. We are not liable for indirect, incidental, or consequential losses (including lost profits), except where mandatory law provides otherwise.

17. Force majeure

We are not liable for delays or failures in performance resulting from causes beyond our reasonable control, including natural disasters, strikes, pandemic restrictions, acts of government, carrier failures, or supplier disruptions.

18. Privacy

We process personal data in accordance with our Privacy Policy. By using the Site you consent to the collection, use, and storage of your personal data as described in that policy.

19. Governing law & dispute resolution

These Terms are governed by the laws of Estonia, except where mandatory local consumer protection law provides otherwise. For consumers, mandatory local consumer law may override aspects of these Terms. Disputes should first be attempted to be resolved informally via our customer support.

20. Changes to these Terms

We may update these Terms occasionally. The “Last updated” date at the top will indicate the most recent revision. Continued use of the Site after a change constitutes acceptance of the updated Terms.
